TERMS AND CONDITIONS FOR MILLIONAIREASIA OVERSEAS MISSION TRIPS

These terms and conditions (“Terms”) apply to all Overseas Mission Trips (“OMT”) organised by Millionaireasia Pte Ltd (“MA”) whose registered office is at 111 Somerset Road, #08-05 TripleOne Somerset, Singapore 238164. The member and any other person taking part in the trip (“Participant”) shall be deemed to have read and accepted the Terms. The Terms may be amended by MA from time to time without prior notice. The amended Terms shall be effective as soon as it is published on MA’s website. By agreeing to MA’s Terms when paying the registration fee, participants are confirming their agreement to the following Terms and of any revised Terms, in force at the time.
1. Making an application
a) By making a registry through MA website, participants warrant that they are legally capable of entering into binding contracts and they are at least 18 years old.
b) Registration is open to Full Members of Millionaireasia and their guests only.
c) All registrations are subject to acceptance by MA at its sole discretion. MA shall notify the participant if the OMT registration has been accepted within fourteen (14) days. MA shall be under no obligation to provide any reason(s) for the rejection of registrations.
d) MA will not accept responsibility for registrations that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. For the avoidance of doubt, proof of posting or transmission of a lost or delayed application for the OMT will not be accepted as a valid or alternative registration.
e) Participants shall represent and warrant that all personal data and information (real name, age, sex, participants’ own e-mail address, etc.) provided during the registration process is up to date, complete, accurate, and true.
f) Registration shall only be performed by the party concerned: registrations on behalf of another party will not be accepted.
g) MA reserves the right to terminate participants’ registry and prohibit future participation of OMT without notice to the participants if it comes to the MA’s attention that any of the registration details participants have provided is not current, incomplete or inaccurate.
2. Types, Fees and Payment
a) All participants are required to pay a registration fee of S$200. This fee shall be refunded to the participants if MA reject their registration. In the event that the participant withdraws the registration, the fees is not refundable.
b) Member can choose to upgrade their flight class and hotel occupancy (single occupancy), at a cost which is provided by MA at the time of registration. Member are not allowed to stay in a non-designated hotel.
c) The participants shall pay the modification charges, cancellation charges, penalty charges, etc. if they cancel the trip within 28 days from the date of departure, according to the airlines, accommodations and events term of service.
d) MA accepts no liability nor responsibility for any loss, prejudice resulting from the modification or cancellation by any participants. The participants shall not be relieved from their obligation to pay.
e) MA reserves the right to adjust its fees and shall provide participants with at least fourteen (14) days’ advance notice in respect of any such adjustment.
3. Company’ exemption
a) MA shall clearly describe the type or range of services for each OMT provided on the Website when providing a service to participants.
b) Priority of the services provided by others (bookings through airlines, etc.) on the Website is not guaranteed. Therefore, seats, accommodations, and other services may not be available for the participants to choose.
c) MA may modify and/or cancel the OMT without the prior consent; If any trip has a potentially invalid and illegal; On the occurrence of any event of force majeure conditions or emergency situations; If MA perceives the necessity of modifying and/or cancelling the OMT.
4. Changes & cancellation
a) MA reserve the right to cancel participants’ registration or change any of the facilities, services or prices described in MA’s documents or website. MA will endeavour to advise participants of any changes known at the time of the registry. A “significant change” refers to a change in more than 24 hours or a major itinerary re-routing. If this does occur after registration, MA will endeavour to offer either a suitable replacement or full refund of money paid. A “significant change” does not include change in transport, food, named accommodation or programme structure.
b) By signing up to MA OMT, participants are acknowledging that the website and documents are an overview of the programmes and services MA offer. Certain changes including alternative accommodation and different project/working hours may occur therefore a flexible working attitude is paramount.
c) MA reserve the right to cancel any registry for reasons of failure on their part to pay the final balance or force majeure (please see definition). If cancellation occurs for either of these reasons, MA will not be liable for any refunds. Force Majeure – Circumstances amounting to “force majeure” include any event which MA or the supplier of the service(s) in question could not even with all due care, foresee or forestall such as war, threat of war, riot, civil strife, industrial dispute, terrorist activity, pandemic or disease, natural or nuclear disaster, fire, adverse weather conditions, all similar events.
d) Changes or cancellations must be notified to MA in writing by email or inform the contact personnel. Changes cannot be requested any less than thirty (30) days prior to their departure date.
e) There may be additional costs due to change in date and/or programme which by requesting a change participant will be liable to absorb these costs. If participant notify MA less than thirty (30) days prior to the proposed departure date the refund policy applicable to cancellation will apply.
f) Transfers to a third party are not permitted.
g) A cancellation will only be effective when MA receive written confirmation via email or point of contact of the cancellation. If participant cancel his/her travel arrangements, then there will be no refund of the Registration fee.
h) The reimbursement for cancellation is stipulated as the following;
i. Notice of more than sixty (60) days: 100% refund minus Registration fee
ii. Notice of between sixty (60) to thirty (30) days: 50% refund minus Registration fee
iii. Less than 30 days: no refund
i) If participant curtail their programme, MA cannot pay any refunds, and they will be responsible for any additional costs involved, including the cost of repatriation. MA reserve the right to charge them an administration fee.
5. Prices & surcharges
The programme and trip prices are exposed to currency fluctuations. MA reserves the right to change any prices at any time. Once the participant registration is confirmed, participants will absorb any increase in cost.
6. Airfares
a) All airfares purchased by MA on behalf of any participants are non-refundable. This includes both airfare deposits and total balances.
b) Any cancellations, changes or refunds are at the discretion of the airline or airfare supplier. MA is not liable for any cancellations or changes made by the airline or participant.
c) If a participant provides their full legal name incorrectly or changes it once the ticket has been purchased in their name, they are liable for any fees which the airline or airfare supplier charge.
7. Passports, Travel Visa’s, Vaccinations and Insurance
a) Any information or advice provided by MA in relation to passports, visa requirements and vaccinations is done so in good faith but without the responsibility of MA. MA will endeavour to publish up-to-date information regarding travel advice and will assist the participants to the best of their ability.
b) It is participant’s responsibility to ensure that they have the correct passport (valid for more than six months from departure date) and visa to gain access to any country/region included in the travel arrangements. If failure to do so, MA have no liability to participant for any cost, loss or damage which they suffer, nor will MA refund them the cost of any unused portion of their trip. Participant should contact their local doctor to arrange an appointment regarding vaccinations.
c) Participants are responsible to meet all regulatory requirements (including but not limited to Covid-19 guidelines) and borne all charges associated with the compliance of the requirement.
d) Participants are required to purchase personal travel insurance to cover the OMT.
8. Personal data protection
a) If participant supply personal data and other information to MA by registering in and/or through the Website and/or MA’s Services, then participant consent to MA collecting, maintaining, using and disclosing such personal data and other information in accordance with MA’s Privacy Policy a copy of which can be accessed here: https://www.millionaireasia.com/privacy-policy/.
b) If participant supply MA with personal data or information on behalf of another individual or about their individual representatives, participants are to ensure that such individual or representative are aware (i) of these Terms and (ii) that they can contact MA by email to contact@millionaireasia.com if they want to have access to the information that MA holds about them, to correct any of that information or to request MA to cease using their contact details to send communications to them.
c) MA takes reasonable precautions to protect the security and privacy of participant use of the Website and/or MA’s Services. However, MA reserves the right to disclose such information as maybe required by it under the law.
d) Participant agree to keep confidential any information provided on the Website and/or through MA’s Services.
9. Limitation of liability
a) MA’s obligations, and those of the suppliers providing any service or facility included in the OMT, are to take reasonable skill and care to arrange for the provision of such services and facilities. Please note, it is participants’ responsibility to show that reasonable skill and care has not been used if they wish to make a claim against MA.
b) In addition, MA will only be responsible for what MA employees and and suppliers do or not do if they were at the time acting within the course of their employment (Staff) or carrying out work on behalf of MA (Suppliers).
c) Neither the participant nor MA shall exclude or limit MA’s liability for (a) death or personal injury caused by negligence, (b) fraud and/or fraudulent misrepresentation.
d) The participant shall not exclude or limit her liability under any indemnities given by her under this Agreement.
e) The participant shall fully and effectively indemnify and hold harmless MA and any Group Company against all losses, actions, costs (including legal fees and disbursements on a solicitor/client basis), claims, demands, fines, damages and liabilities, of whatever nature, incurred or suffered by or made against MA, whether or not foreseeable, arising directly or indirectly, wholly or in part, out of or in connection with: any breach of this Agreement by the participant; and any acts or omissions of the individual.
f) MA shall not (whether in contract, tort, negligence, statutory duty or otherwise) be liable to the participant under this Agreement for consequential, indirect or special damages (including indirect loss of profit and indirect loss of revenue).
g) Subject to the clauses above, MA’s maximum aggregate liability to the participant under this Agreement (whether arising in contract, tort, negligence, statutory duty or otherwise) shall not exceed the Fees the participant paid to MA.
h) This Clause 6 shall survive termination of these Terms.
10. Acceptance of risk
MA carefully vets all elements of packages offered via risk assessments. MA take the upmost care of limiting any risk involved in the packages. MA accept participants registration on the understanding that they appreciate the potential risks involved in participating in packages, including loss/damage to personal property, inconvenience and discomfort, injury or illness.
11. Miscellaneous
a) MA reserves the right to interpret, apply and communicate these Terms as posted on its website. All decisions made by MA shall be final and conclusive in each case.
b) These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any unresolved dispute arising under, out of, or in connection with these Terms, including any questions regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force.
c) Notwithstanding anything in these Terms, in the event of any dispute no party shall proceed to any dispute resolution unless the parties have made reasonable efforts to resolve the same through mediation in accordance with the mediation rules of the Singapore Mediation Centre for the time being in force.
d) To the extent that any provision contained or referred to herein is contrary to anything contained in any applicable laws, government regulations, orders or requirements that cannot be waived by agreement of the parties, such provision shall not apply. The invalidity of any provision shall not affect the validity of any other provision.
